Members-only Fireside Chat: The Paycheck Protection Program (PPP) Loans / Federal Acquisition Regulation (FAR) Credits Clause Issue Remains. What Should Your Firm Do?

Originally in the National Defense Authorization Act (NDAA), ACEC National helped create an amendment that would have allowed engineering firms to remove any credit to their indirect rate schedule resulting from a PPP loan. Unfortunately the NDAA passed without ACEC’s language to address this PPP/FAR credits clause problem. Thus, for the 2022 indirect cost schedule, state departments of transportation will be looking for the credit as a result of the PPP loan forgiveness. 

Daniel Markham, CPA of Markam & Associates will discuss some strategics for addressing this. In the meantime, ACEC National is committee to continuing work on this issue and is coordinating with Capitol Hill allies to identify additional legislative vehicles early in 2022 to address this.
